In addition, it is sufficient to explain the revocation to the representative if you have only given the power of attorney to him.

If you have also announced the power of attorney externally, you must also carry the revocation externally. So outsiders can trust in the existence of the power of attorney until they are told otherwise.

For example, if an employee is a proxy, this power of attorney also ends when the employment relationship ends. However, you must declare the power of attorney to the business partners concerned. A public announcement would be sufficient.

A power of attorney does not necessarily expire with the death of a person. It is transferred to the heirs of the principal. There are also so-called irrevocable powers of attorney. These can only be revoked if there is an important reason for the revocation. In general, however, such powers of attorney should not be entered into in the first place.

 

Revoke power of attorney: Form!

As described above, the revocation of a power of attorney must have the same form as the power of attorney itself. In theory, the revocation can also be pronounced orally. Because it is easier to prove, it is always best to use the written form. However, there are powers of attorney for which a certain form is required. These must also be revoked accordingly. For example, the revocation of a power of attorney must be documented in the commercial register.
