1. Scope

The following terms and conditions apply to all orders via our online shop bibukurse.de.


2. Contractual partner, customer service

The contractual partner for all orders - that means, for example, when participating in an online course or webinars - is examio GmbH - Managing Director: Simon Julius Dücker. For technical reasons, payment processing on all learning portals is handled by examio GmbH, Friedrichstrasse 20, 57079 Siegen. “Examio GmbH” therefore appears in all payment transactions that are related to course bookings via this website as the payee or, in the case of refunds, as the payer. 4. Conclusion of a contract

By placing the products in the online shop, we are submitting a binding offer to conclude a contract for these items. The contract is concluded when you click the order button to accept the offer for the online courses or webinars contained in the shopping cart. Immediately after submitting the order, you will receive another confirmation by email.

The condition for the effective conclusion of a contract is always that the order process is completed when the order is sent.


5. Due date

Online courses with a fixed duration are offered that you can purchase for a one-time payment (so-called individual courses). For these online courses, the agreed course fee is due with the purchase of the course.

In addition, online courses with a flexible duration are offered on a monthly basis. These online courses usually consist of several sub-topics or cover entire subject areas. They are therefore called “complete packages”. They are characterized by the monthly subscription and also by the payment of monthly course fees. When booking such subscriptions, the first course fee is also due with the purchase of the course. The other monthly course fees are then collected on the date on which the course was purchased (for example: purchase on October 22nd - due date for course fees on the 22nd of each month; purchase on January 31st - due date for course fees on the last calendar day of month).

In the case of paid webinars, the course price is due when you register for the webinar. We reserve the right to cancel offered webinars for organizational reasons. If the webinar does not take place, the course price will be reimbursed accordingly.

When booking a paid webinar, there is basically no entitlement to a recording of the event. For technical reasons it can happen that such recordings cannot be made if the server load is very high. To clarify, there is therefore no entitlement to partial or full reimbursement of the course fee in the rare event that a recording cannot be made available.


6. Payment

Payment is made in advance, credit card, direct debit or PayPal. For technical reasons, payment processing is carried out on all portals by examio GmbH, with the assistance of the payment service provider Unzer, Unzer GmbH Vangerowstraße 18, 69115 Heidelberg.

The following payment methods are currently offered:

Payment in advance
If you choose the payment method “advance payment”, we will give you our bank details in the order confirmation and activate the booked online courses after receipt of payment.

Credit card
Your credit card will be charged when the order is completed. The online course is activated when the order is completed, so that you can start processing the online course immediately after completing the order.

Direct debit / SEPA direct debit
The purchase price is debited from your account when the order is completed. The online course is activated when the order is completed, so that you can start processing the online course immediately after completing the order.

In the case of payment by “direct debit”, each course fee is increased by the transaction costs invoiced to us by third parties by at least 8 euros if the collection is unsuccessful (e.g. due to insufficient funds or unjustified objection).

Paypal
You pay the invoice amount via the online provider “PayPal”. In principle, you must be registered there or register first, legitimize with your access data and confirm the payment instructions to us (exception, if applicable, guest access). You'll get more information during the ordering process. The online course is activated when the order is completed, so that you can start processing the online course immediately after completing the order.

Note: Subscriptions cannot currently be taken out and paid for by bank transfer, Sofort-Überweisung or PayPal.


7. Termination

It is not necessary to cancel individual purchases for so-called individual courses. For these courses, a one-time fee is paid for participation in the course. These courses have a fixed duration, which you can find in the product descriptions.

In addition, subscriptions for so-called “complete packages” are offered, in which a monthly course fee is paid for participation in the course. These subscription products have different minimum contract periods. Depending on the product booked, this is currently at least four weeks, but no more than one year. The minimum contract periods can be found in the respective product description. After the end of the minimum contract period, the subscriptions do not end automatically, but can be canceled on a monthly basis.

The subscription can be canceled by either party in writing, observing the minimum contract period, with a notice period of 14 days to the end of the course month. For example, if you book the subscription on the 17th of a month, it can only be terminated on the 17th of each month.

If there is an important reason, we may give extraordinary notice of two weeks in writing. An important reason exists in particular if you are repeatedly in arrears with a due payment despite a reminder.

8. Examination course

We offer exam courses as a monthly subscription. Part of the performance of written exams is not only the provision of exams and exam corrections, but also access to the learning portal. The learning portal offers many other learning options (e.g. all documents, webinars, webinar recordings), which are also covered by the monthly subscription payments.

A fixed number of exams will be made available to you as part of the exam courses. These exams are activated depending on the activation interval you have chosen. When choosing a product, you also have the option of booking these courses with and without a correction service. If all exams of a course have been activated, no further exams will be activated. Accordingly, in the case of a correction service, there are no further correction services. Corrections are only made within an active subscription. This subscription does not end automatically either. With regard to the termination of the subscription, the above regulations apply.


9. Observance and protection of copyrights and trademarks

The documents (scripts, cases, graphics, podcasts, videos, etc.) issued as part of an online course or webinar or made available for retrieval via the Internet are protected by copyright. The brands and logos listed on the documents are protected under the Trademark Act. Each participant is obliged to use the documents and files accessible to him only in the framework expressly permitted here or in accordance with mandatory statutory provisions even without our consent and not to promote unauthorized use by third parties. This also applies after participation has ended. The files and documents may only be accessed (download) and printed out by course participants and only for their own advanced training. The downloading and printing of files is only permitted within this framework - in this respect, each participant may have the printing carried out with the technical support of third parties (e.g. a copy shop). In addition, all rights of use to the files and documents are reserved. Therefore, in particular, making copies of files or printouts for third parties, forwarding or forwarding files to third parties or other use for purposes other than one's own study, whether for a fee or free of charge, even after completion of the course, requires the express prior written consent of examio GmbH . Forms of use that are permitted due to mandatory legal provisions are of course excluded from this reservation of consent.


10. Confidentiality of the access data

Each participant is obliged to keep their access data (user name and password) for the individual use of the online offers available on our learning platform secret and not to pass them on to third parties. At the request of the participant, we will delete the access data at any time and replace it with another code.


11. Own provision of suitable IT infrastructure and software

Each participant is responsible for providing and guaranteeing Internet access (hardware, telecommunications connections, etc.) and the other technical equipment and software required for using our online services (in particular web browsers and Acrobat Reader®) on their own Responsible for costs and at your own risk.


12. Changes to the Conditions of Participation

We reserve the right to change these conditions through deletions, replacements or additions. In such a case, we will notify our participants of the change in our conditions. Every participant has the right to comment within a period of 14 days from receipt of the notice as to whether he or she agrees to the changed conditions. If we do not receive a declaration within the period, consent to the changed conditions is deemed to have been given. However, this does not apply if we did not point out the change to our conditions to the participant at the same time as the importance of his silence during the period.

14. Cancellation policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day the contract is concluded.

Consequences of withdrawal

If you cancel this contract, we have to repay all payments that we have received from you immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.
